3.1. Objectives The overall objective of the proposed programme is to contribute towards poverty reduction in the least developed countries by providing equitable access to basic education and skills development to the most disadvantaged section of the society. The project purpose is to strengthen capacity of the national and local ACP authorities in the formulation, implementation and enforcement of policies to fight child labour in coordination with social partners and civil society. 3.2. Expected results and main activities Africa, the Caribbean and the Pacific are at different stages in addressing education and child labour challenges. Therefore, the approach in the three regions will be different both in size and scope. Some countries involved in the project face major challenges in tackling child labour and developing education, which is certainly the case for all the countries in Africa. In some other countries the scale of the overall child labour problem may be on a lesser scale, though still serious particularly where worst forms of child labour are concerned. Clearly different approaches may be required, according to local situations. Therefore the detail of interventions will be formulated in consultation with local stakeholders taking account of local needs and circumstances in different countries. However, in all regions, the strategy followed by the project will have two main elements. Firstly the project will try to strengthen the enabling environment. This is achieved by promoting a positive legal and policy framework, by developing the knowledge base and strengthening networks on child labour and education, and by developing the capacity of governments and other relevant bodies. This links with the second element of the strategy which will focus on withdrawal of children from child labour, the prevention of child labour, and development of effective intervention models which can be replicated. Result 1 - Country level legal framework prepared or strengthened where already in existence. The countries involved are at different stages in the development of legal frameworks on child labour and education. It is vital to review and/or to assess the existing legal framework in view of facilitating the legislative process that can lead to an elaboration of a legal framework that is in accordance with ILO’s Child Labour Conventions Nos. 138 (1973) and 182 (1999), and makes child labour and education legislations consistent. In some countries the coherence between education and labour legislation needs to be strengthened, most importantly by ensuring that there is correspondence between the end of compulsory education and the Minimum Age for entering into employment. It is important to harmonise all areas of legislation that refer to children’s rights, particularly the right to education. Putting the legal framework in place is only the first step. The next challenge is how to effectively enforce this legislation. Even countries that have sound child labour laws usually find it difficulty to apply them in practice, irrespective of their level of development. Therefore, it is also important to go beyond legal text and consider coherence in the implementation and enforcement machinery. Therefore the project will combine work aimed at assessing and improving the legislative environment with activities to help ensure effective implementation systems and measures, with particular focus on child labour inspection mechanisms and child labour monitoring. The main methods used for achieving these results will be through inter alia, provision of technical advice on legislation and on setting up/strengthening of required enforcement mechanisms, through missions of specialists, provision of support to drafting committees or workshops.
