Support for an independent arbitration council in Cambodia

The International Labour Organization (ILO) has been working closely with employers, unions and the Ministry in charge of Labour(1) to develop Cambodia's industrial relations system. One important aspect of this cooperation is the Labour Dispute Resolution Project (LDRP). During the first phase of this project, from January 2002 through December 2005, Cambodia's first national Arbitration Council was established. A second phase of the project has been approved by the Cambodian tripartite constituents and donors (NZAID, USAID, and USDOL) in order to help implement the National Strategy on Labour Dispute Prevention and Settlement. The ILO-LDRP Project has assisted the Ministry for Labour, the union movement and employers associations, in developing strategies for labour dispute prevention and resolution, in establishing and implementing transparent, fair and expeditious dispute procedures and in the building of capacity to resolve disputes at the earliest possible stage. The ILO-LDRP focuses on the following four areas: dispute prevention (including capacity building of the Ministry for Labour), conciliation, arbitration and adjudication. (1) When cooperation began in 2002, the relevant Ministry was the Ministry for Social Affairs, Labour, Vocational Training and Youth Rehabilitation (MOSALVY); with the formation of a new government and concurrent ministerial re-organization in July and August 2004, the relevant Ministry is now the Ministry of Labour and Vocational Training (MOLVT).
